Additional Notices

Anyone who is not a general contractor must satisfy additional notice requirements. In part, these additional notices are required because there may be intermediate parties in the contractual chain between the claimant and the original contractor. Other notices alert the owner and contractor to special situations, such as the production of specially fabricated materials and the existence of retainage agreements. Some are designed to trigger provisions of other statutes such as those involved in trapping funds under Property Code Section 53.101. Additional notice requirements relate to the following:


1. Retention agreements.

2. Specially fabricated material [Tex. Prop. Code ? 53.058].

3. Claims based on debts incurred by a subcontractor.

4. Claims based on debts incurred by certain general contractors.

5. Fund trapping notices.

6. Residential construction projects.
